PRIVACY NOTICE FOR CUSTOMERS

This Privacy Notice (“Notice”) sets out the basis and the explanation of practice Topcon Instruments (Thailand) Co. Ltd. (“Topcon”, “we”, “us”, or “our”) regarding the collection, use, disclosure or other processing of your personal data in accordance with the Personal Data Protection Act B.E. 2562 (2019) (“PDPA”).

DEFINITION

  1. Under this Notice:
    “Customer” means an data subject who (a) has contacted us through any means to find out more about any goods or services we provide, or (b) may, or has, entered into a contract with us for the supply of any goods or services by us; and
    “Personal Data” means any information relating to a person, which enables the identification of such person, whether directly or indirectly, but not including the information of the deceased persons.
  2. Other terms used in this Notice shall have the meanings given to them in the PDPA (where the context so permits). 

COLLECTION OF PERSONAL DATA

  1. Depending on the nature of your interaction with us, some examples of Personal Data which we may collect from you include name, identification numbers, and birth certificate, residential address, email address, telephone number, nationality, gender, date of birth, marital status.

    We may collect, use or disclose your sensitive personal data when we have obtained explicit consent from you unless permitted by the law.

    In addition, if you do not provide us with such necessary Personal Data, we may not be able to provide you with our products and services and/or may not be able to manage or administer the contract or give any convenience for you as our Customer.

STORAGE OF DATA

We will keep your Personal Data in document and electronic form. We store your Personal Data on our company’s server in Thailand and on our company’s server outside Thailand.

COLLECTION, USE AND DISCLOSURE OF PERSONAL DATA

  1. We generally do not collect your Personal Data unless (a) it is provided to us voluntarily by you directly or via a third party who has been duly authorised by you to disclose your personal data to us (your “authorised representative”) after (i) you (or your authorised representative) have been notified of the purposes for which the data is collected, and (ii) you (or your authorised representative) have provided written consent to the collection and usage of your personal data for those purposes, or (b) collection and use of personal data without consent is permitted or required by the PDPA or other laws.

    We shall seek your consent before collecting any additional Personal Data and before using your Personal Data for a purpose which has not been notified to you under this Notice unless permitted or authorised by law to do so.
  1. We may collect and use your Personal Data for any or all of the following purposes
    • performing obligations in the course of or in connection with our provision of the goods and/or services requested by you;
    • verifying your identity;
    • responding to, handling, and processing queries, requests, applications, complaints, and feedback from you;
    • managing your contractual relationship with us;
    • processing payment or credit transactions;
    • complying with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;
    • for purposes of sales of product – providing with products and services that Topcon and its subsidiaries and partners offer (“Products“) and managing contractual relationship related to providing Products and other business activities;
    • for purposes of use of product – Planning, development, manufacturing, installation, support, training and maintenance of machines and equipment, providing and distributing information such as information on Products, contact you about warranty, service and sales issues;
    • for purposes of marketing and communication – to send you free publications like product news and insights, press releases and company news, as well as invitations for events, training and webinars (you may unsubscribe from these communications at any time);
    • to send you other e-mail-marketing related to direct marketing, we reserve the right to send you information on goods and services similar to those you have purchased from us by e-mail. You can object to receiving such information by email at any time. Each email contains information on how to unsubscribe from future emails;
    • for purposes of improvement of our Website – personalizing your experience at our websites; selectively sending you information that may be of interest to you; contests and sweepstakes; market research and online surveys; automatic monitoring of statistical information to determine how Topcon’s websites are being used;
    • for purposes of improvement of our Products – Conducting surveys on Products and analysis of the results. The processing of personal data is carried out because Topcon has a predominant legitimate interest to enhance your experience and to develop and improve our products; and
    • any other incidental business purposes related to or in connection with the above purposes.

DISCLOSURE OF PERSONAL DATA

  1. We may disclose your Personal Data that you consented us or as permitted by law to the following parties:

    Service Providers
    We may disclose your personal data to our service providers as necessary to provide our services such as payments, marketing, products and services development or such disclosure is required for performing obligations in the course of or in connection with our provision of the goods and services requested by you. For more information about the how our service providers collect and how they use this information. Please see the privacy notice or privacy policy of such service providers.

    Business Partners
    In relation with our business partners, we may disclose certain personal data to them in order to coordinate and provide our products or services to you and provide necessary information about the availability of our products or services.

    Business Transfer
    In connection with any reorganization, restructuring, merger or acquisition, or other transfer of assets, we may transfer information, provided that the receiving party agrees to respect your personal data in a manner that is consistent with this Notice and PDPA.

DATA SUBJECT RIGHTS

  1. When you provide us with your Personal Data. You have the rights through which you can exercise your rights free of charge, under the exception of the law.

    Subject to the PDPA thereof, you may exercise any of these rights in the following:

    Right to withdraw consent
    The consent that you provide to us for the collection, use and disclosure of your Personal Data will remain valid until such time it is being withdrawn by you in writing. You may withdraw consent and request us to stop collecting, using and/or disclosing your Personal Data for any or all the purposes listed above.

    Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing our goods or services to you and we shall, in such circumstances, notify you before completing the processing of your request. Should you decide to cancel your withdrawal of consent, please inform us in writing. 

    Please note that withdrawing consent does not affect our right to continue to collect, use and disclose Personal Data where such collection, use and disclose without consent is permitted or required under applicable laws including the processing of Personal Data you have already given consent to us legally.

    Right to access
    You have the right to request us for access to a copy of the personal data which we hold about you or information about the ways in which we use or disclose your Personal Data.

    Right to rectification
    You have the right to request us to correct or update any of your Personal Data which we hold about you to be updated, complete and not misleading, you may submit your request in writing or via the contact details provided below. 

    Right to data portability
    You have the right to obtain your Personal Data if we organize such Personal Data in automatic machine-readable or usable format and can be processed or disclosed by automatic means. You may request us to send or transfer the Personal Data in such format directly to other data controllers if doable by automatic means; and to request to obtain the Personal Data in such format sent or transferred by us directly to other data controllers unless not technically feasible.

    Right to objection
    You have the right to object to collection, use or disclosure of your Personal Data at any time if such doing is conducted for legitimate interests of us, corporation or individual which is within your reasonable expectation; or for carrying out public tasks.

    Right to erasure
    You have the right to request us to erase, destroy or anonymize your Personal Data if you believe that the collection, use or disclosure of your Personal Data is against relevant laws; or retention of the data by us is no longer necessary in connection with related purposes under this Notice; or when you request to withdraw your consent or to object to the processing as earlier described.

    Right to restriction
    You have the right to request us to suspend processing your Personal Data during the period where we examine your rectification or objection request; or when it is no longer necessary, and we must erase or destroy your Personal Data pursuant to relevant laws, but you request us to suspend the processing instead.

    Right to lodge a complaint
    You have the right to complain to competent authorities pursuant to relevant laws if you believe that the collection, use or disclosure of your Personal Data is violating or not in compliance with relevant laws.
  2. We will respond to your request as soon as reasonably possible. In general, our response will be within fourteen (14) business days. Should we not be able to respond to your request within thirty (30) days after receiving your request, we will inform you in writing within thirty (30) days of the time by which we will be able to respond to your request. If we are unable to provide you with any Personal Data or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so.

PROTECTION OF PERSONAL DATA

  1. To safeguard your Personal Data from unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks, we have introduced appropriate administrative, physical and technical measures such as up-to-date antivirus protection, encryption, use of privacy filters, and disclosing Personal Data both internally and to our authorised third party service providers and agents that are obliged to maintain the confidentiality of your Personal Data by complying with the data security standards and policies when any of Personal Data is being used, transmitted, transferred or processed. 
  2. You should be aware, however, that no method of transmission over the Internet or method of electronic storage is completely secure. While security cannot be guaranteed, we strive to protect the security of your information and are constantly reviewing and enhancing our information security measures.

ACCURACY OF PERSONAL DATA

  1. We generally rely on Personal Data provided by you (or your authorised representative). In order to ensure that your Personal Data is updated, complete and accurate, please update us if there are changes to your Personal Data by contact us via the contact details provided below.

RETENTION OF PERSONAL DATA

  1. We may retain your Personal Data for as long as it is necessary to fulfil the purpose for which it was collected, or as required or permitted by applicable laws.
  2. We will cease to retain your Personal Data or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the Personal Data was collected and is no longer necessary for legal or business purposes.

CROSS-BORDER DATA TRANSFER

  1. We generally do not transfer your personal data to countries outside of Thailand. However, if we do so, we will obtain your consent for the transfer to be made and we will take steps to ensure that the destination country provide an adequate security measure and your Personal Data will continues to receive a standard of protection that is at least comparable to that provided under the PDPA.
  2. As we have networks, databases, servers, systems, support, and help desks located throughout our offices around the world. We collaborate with third parties such as cloud hosting services, suppliers, and technology support located around the world to serve the needs of our business, workforce, and customers. We take appropriate steps to ensure that Personal Data is processed, secured, and transferred according to applicable law. In some cases, we may need to disclose or transfer your Personal Data within Topcon or to third parties in areas outside Thailand. The areas in which these recipients are located will vary from time to time, but may include the United States, Japan, Europe, Singapore and other countries where Topcon has a presence or uses contractors.

COOKIES

  1. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. 
  2. If you disable cookies off, some features will be disabled. It will turn off some of the features that make your site experience more efficient and some of our services will not function properly.

DATA BREACH NOTIFICATION

  1. In case of data breach incident, we will notify the Office of the Personal Data Protection Committee without delay and, where feasible, within 72 hours after having become aware of it. If the Personal Data breach is likely to result in a high risk to the rights and freedoms of you, we will also notify the Personal Data breach and the remedial measures to you without delay through our website, SMS, email address, telephone or registered mail (if applicable).

  1. The purpose of this Notice is to offer products or services and use of our website only. Any websites from other domains found on our website is subject to their privacy notice or privacy policy which is not related to us.

EFFECT OF NOTICE AND CHANGES TO NOTICE

  1. This Notice applies in conjunction with any other notices, contractual clauses and consent clauses that apply in relation to the collection, use and disclosure of your Personal Data by us.
  2. We may revise this Notice from time to time without any prior notice. You may determine if any such revision has taken place by referring to the date on which this Notice was last updated. Your continued use of our services constitutes your acknowledgement and acceptance of such changes.

ประกาศว่าด้วยความเป็นส่วนตัวของลูกค้า

ประกาศว่าด้วยความเป็นส่วนตัวฉบับนี้ (“ประกาศ”) จัดทำขึ้นเพื่อกำหนดหลักเกณฑ์และอธิบายถึงวิธีการปฏิบัติของ       บริษัท ท็อปคอน อินสทรูเม้นท์ (ไทยแลนด์) จำกัด (“ท็อปคอน” หรือ “เรา”) ที่เกี่ยวข้องกับการเก็บรวบรวม ใช้ เปิดเผย หรือวิธีการประมวลผลข้อมูลอื่นใดต่อข้อมูลส่วนบุคคลของท่านให้เป็นไปตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (“กฎหมายคุ้มครองข้อมูลส่วนบุคคล”)

คำนิยาม

  1. ภายใต้ประกาศฉบับนี้:
    “ลูกค้า” หมายความว่า เจ้าของข้อมูลส่วนบุคคลซึ่ง (ก) ติดต่อเราผ่านวิธีการใดก็ตามเพื่อสอบถามเพิ่มเติมเกี่ยวกับสินค้าหรือบริการที่เราจัดเตรียมให้ หรือ (ข) ผู้ซึ่งอาจจะ หรือได้ทำการเข้าสัญญากับเราเพื่อให้เราจัดหาไว้ให้ซึ่งสินค้าหรือบริการใด ๆ ก็ตาม และ

    “ข้อมูลส่วนบุคคล” หมายความว่า ข้อมูลใดก็ตามที่เกี่ยวข้องกับตัวบุคคลที่สามารถทำให้ระบุตัวตนของบุคคลดังกล่าวได้ไม่ว่าจะทางตรงหรือทางอ้อมก็ตาม แต่ไม่รวมถึงข้อมูลของบุคคลผู้ถึงแก่กรรม
  2. คำนิยามอื่นใดที่ใช้ภายใต้ประกาศฉบับนี้ให้มีความหมายเช่นเดียวกับตามที่ได้กำหนดไว้ในกฎหมายคุ้มครองข้อมูลส่วนบุคคล (ตราบเท่าที่เนื้อหามีความเกี่ยวข้อง)

การเก็บรวบรวมข้อมูลส่วนบุคคล

  1. การเก็บรวบรวมข้อมูลส่วนบุคคลนั้นจะขึ้นอยู่กับความสัมพันธ์ที่ท่านมีอยู่กับเรา โดยข้อมูลส่วนบุคคลที่เราเก็บรวบรวมจากท่านอาจรวมถึง ชื่อ รหัสบัตรประชาชน สูติบัตร ที่อยู่ อีเมล เบอร์โทรศัพท์ สัญชาติ เพศ วันเกิด สถานะสมรส

    เราอาจทำการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลที่มีความอ่อนไหวของท่านต่อเมื่อเราได้รับความยินยอมโดยชัดแจ้งจากท่าน เว้นเสียแต่กฎหมายได้อนุญาตให้กระทำได้

    นอกจากนี้ หากท่านไม่ให้ข้อมูลส่วนบุคคลที่มีความจำเป็นต่อเรา เราอาจไม่สามารถจัดเตรียมสินค้าหรือบริการให้แก่ท่าน และ/หรือ อาจไม่สามารถบริหารหรือจัดการทางสัญญา หรืออำนวยความสะดวกใด ๆ ให้แก่ท่านในฐานะลูกค้าได้

การเก็บรักษาข้อมูล

เราจะเก็บรักษาข้อมูลส่วนบุคคลของท่านที่เราได้รับมาในรูปแบบเอกสารและรูปแบบอิเล็กทรอนิกส์ เราเก็บรักษาข้อมูลส่วนบุคคลของท่านบนเซิร์ฟเวอร์บริษัทภายในประเทศไทยและเซิร์ฟเวอร์บริษัทภายนอกประเทศไทย

การเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคล

  1. โดยทั่วไปแล้วเราจะไม่ทำการเก็บรวบรวมข้อมูลส่วนบุคคลของท่าน เว้นแต่ว่า (ก) เราได้รับข้อมูลส่วนบุคคลดังกล่าวโดยตรงจากท่านหรือผ่านทางบุคคลภายนอกผู้ซึ่งได้รับอำนาจจากท่านให้ทำการเปิดเผยข้อมูลให้แก่เรา (“ตัวแทนผู้มีอำนาจของท่าน”) ภายหลังจากที่ (1) ท่าน (หรือตัวแทนผู้มีอำนาจของท่าน) ได้รับการแจ้งเกี่ยวกับวัตถุประสงค์สำหรับการเก็บรวบรวมนั้น และ (2) ท่าน (หรือตัวแทนผู้มีอำนาจของท่าน) ได้ให้ความยินยอมเป็นหนังสือแก่เราในการเก็บรวบรวมและใช้ข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์เหล่านั้น หรือ (2) การเก็บรวบรวมและการใช้ข้อมูลส่วนบุคคลโดยปราศจากความยินยอมนั้นมีการอนุญาตหรือกำหนดให้ต้องกระทำตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลหรือกฎหมายอื่นใด

    เราจะขอความยินยอมจากท่านก่อนทำการเก็บรวบรวมข้อมูลส่วนบุคคลอื่นใดและก่อนการใช้ข้อมูลส่วนบุคคลที่ไม่ได้มีการระบุไว้ภายใต้ประกาศฉบับนี้ เว้นเสียแต่ได้รับอนุญาตหรือสามารถกระทำได้ตามที่กฎหมายกำหนดไว้
  1. เราอาจทำการเก็บรวบรวมและใช้ข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงใดหรือเพื่อวัตถุประสงค์ทั้งหมดที่ได้กำหนดไว้ ดังต่อไปนี้:
    • ปฏิบัติตามภาระผูกพันในการปฏิบัติงานที่เกี่ยวข้องกับสินค้า และ/หรือ บริการของเราตามที่ได้มีการร้องขอโดยท่าน
    • ทำการระบุตัวตนของท่าน
    • ตอบกลับ จัดการ และดำเนินการในข้อสงสัย ข้อเรียกร้อง การสมัคร การร้องเรียน และคำติชมจากท่าน
    • จัดการทางด้านความสัมพันธ์ทางสัญญาที่ท่านมีกับเรา
    • ดำเนินการชำระเงินหรือธุรกรรมทางเครดิต
    • ปฏิบัติตามกฎหมายที่บังคับใช้ ข้อบังคับ หลักปฏิบัติ แนวทาง หรือกฎเกณฑ์ หรือเพื่อช่วยเหลือในการบังคับใช้ทางกฎหมายและการสืบสวนที่กระทำโดยหน่วยงานราชการหรือเจ้าหน้าพนักงานรัฐที่มีอำนาจ
    • เพื่อวัตถุประสงค์ในการค้าขายสินค้า – ซึ่งได้แก่สินค้าและบริการที่ท็อปคอนและบริษัทย่อยและหุ้นส่วนได้มีการเสนอ (“สินค้า”) และการจัดการทางด้านความสัมพันธ์ทางสัญญาที่เกี่ยวข้องกับการจัดเตรียมสินค้าและกิจกรรมทางธุรกิจอื่น ๆ

    • เพื่อวัตถุประสงค์ในการทำการตลาดและการสื่อสาร – เพื่อส่งการประชาสัมพันธ์โดยไม่เสียค่าใช้จ่ายให้แก่ท่าน เช่น ข่าวสินค้าใหม่และข่าววงการภายใน การแถลงข่าวสารและข่าวสารเกี่ยวกับบริษัท รวมไปถึงการส่งคำเชิญเพื่อเข้าร่วมงานกิจกรรม การอบรมและสัมมนา (ท่านสามารถยกเลิกการส่งข้อมูลเหล่านี้ได้ตลอดเวลา)
    • เพื่อการนำส่งอีเมลทางการตลาดอื่นใดที่เกี่ยวข้องกับการตลาดโดยตรง เราขอสงวนสิทธิในการส่งข้อมูลเกี่ยวกับสินค้าและบริการที่เกี่ยวข้องกับสิ่งที่ท่านได้เลือกซื้อจากเราผ่านอีเมล ทั้งนี้ ท่านสามารถทำการยกเลิกการรับอีเมลดังกล่าวได้ตลอดเวลา โดยอีเมลแต่ละฉบับจะมีข้อมูลเกี่ยวกับการยกเลิกการได้รับอีเมลที่นำส่งให้ในอนาคต
    • เพื่อวัตถุประสงค์ในการปรับปรุงเว็บไซต์ของเรา – การปรับเปลี่ยนประสบการณ์ใช้งานของท่านบนเว็บไซต์ของเรา คัดเลือกและนำส่งข้อมูลที่ท่านอาจมีความสนใจ จัดการประกวดและลุ้นรางวัล การค้นคว้าทางการตลาดและการทำแบบสอบถามออนไลน์ การสังเกตุการณ์โดยอัตโนมัติในข้อมูลสถิติเพื่อใช้ในการวิเคราะห์ว่าเว็บไซต์ของเรามีการใช้งานอย่างไร
    • เพื่อวัตถุประสงค์ในการปรับปรุงสินค้าของเรา – ทำการสอบถามถึงตัวสินค้าและวิเคราะห์ในผลที่ได้รับ การประมวลผลข้อมูลส่วนบุคคลดังกล่าวเกิดขึ้นเพราะท็อปคอนมีประโยชน์โดยชอบธรรมด้วยกฎหมายเพื่อทำการปรับปรุงประสบการณ์ของท่านและพัฒนาและปรับปรุงสินค้าของเรา และ

การเปิดเผยข้อมูลส่วนบุคคล

  1. เราอาจทำการเปิดเผยข้อมูลส่วนบุคคลของท่านตามที่ท่านได้ให้ความยินยอมแก่เราหรือเมื่อกฎหมายได้อนุญาตให้กระทำได้ให้แก่บุคคลดังต่อไปนี้:

    ผู้ให้บริการ
    เราอาจทำการเปิดเผยข้อมูลส่วนบุคคลของท่านให้แก่ผู้ให้บริการของเราเท่าที่จำเป็นในการให้บริการของเราแก่ท่าน เช่น การชำระเงิน การตลาด การพัฒนาสินค้าและบริการ หรือ การเปิดเผยดังกล่าวมีความจำเป็นเพื่อปฏิบัติตามภาระผูกพันธ์อันเนื่องมาจากหรือเกี่ยวข้องกับสินค้าหรือการบริการที่ร้องขอโดยท่าน สำหรับรายละเอียดเพิ่มเติมเกี่ยวกับวิธีการที่ผู้ให้บริการของเราเก็บรวบรวมและวิธีการใช้ของผู้ให้บริการของเรานั้น โปรดตรวจสอบประกาศว่าด้วยความเป็นส่วนตัวหรือนโยบายความเป็นส่วนตัวของผู้ให้บริการดังกล่าว

    พันธมิตรทางธุรกิจ
    ในเรื่องที่เกี่ยวเนื่องกับพันธมิตรทางธุรกิจของเรานั้น เราอาจมีการเปิดเผยข้อมูลส่วนบุคคลของท่านบางส่วนให้แก่พันธมิตรทางธุรกิจเพื่อการช่วยเหลือและจัดเตรียมสินค้าหรือบริการให้แก่ท่านและเพื่อจัดเตรียมข้อมูลที่มีความจำเป็นในการเตรียมความพร้อมของสินค้าและบริการของเรา

    การถ่ายโอนทางธุรกิจ
    เราอาจเปิดเผยข้อมูล รวมถึงข้อมูลส่วนบุคคลของท่าน สำหรับการปรับโครงสร้างองค์กร การควบรวมหรือการขายกิจการ หรือการถ่ายโอนสินทรัพย์อื่น ๆ โดยฝ่ายผู้รับโอนยินยอมที่จะปฏิบัติกับข้อมูลของท่านในลักษณะที่สอดคล้องกับประกาศฉบับนี้และกฎหมายคุ้มครองข้อมูลส่วนบุคคล

  1. เมื่อท่านให้ข้อมูลส่วนบุคคลแก่เรา ท่านมีสิทธิหลายประการซึ่งสามารถดำเนินการใช้สิทธิได้โดยไม่เสียค่าใช้จ่ายภายใต้ข้อยกเว้นตามกฎหมาย

    สิทธิของท่านภายใต้กฎหมายคุ้มครองข้อมูลส่วนบุคคล มีดังต่อไปนี้

    สิทธิในการขอถอนความยินยอม
    ความยินยอมที่ท่านได้ให้เราในการเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่านจะยังมีผลใช้บังคับได้ต่อไปจนกว่าจะถูกบอกเลิกโดยตัวท่านเป็นหนังสือ ท่านสามารถถอนความยินยอมและร้องขอให้เราหยุดการเก็บรวบรวม ใช้ และ/หรือ เปิดเผยข้อมูลส่วนบุคคลของท่านสำหรับวัตถุประสงค์ใดหรือวัตถุประสงค์ทั้งหมดที่ได้ระบุไว้ข้างต้น

    ในขณะที่เราเคารพในการตัดสินใจขอถอนความยินยอมโดยท่านนั้น โปรดทราบว่าการขอถอนความยินยอมจะขึ้นอยู่กับลักษณะและขอบเขตการขอถอนความยินยอมของท่าน เราอาจไม่อยู่ในสถานะที่จะคงไว้ซึ่งสินค้าหรือการให้บริการแก่ท่านและเรามีความจำเป็นจะต้องแจ้งแก่ท่านก่อนดำเนินการตามคำร้องของท่านจะเสร็จสิ้น ทั้งนี้ หากท่านเลือกที่จะยกเลิกการขอถอนความยินยอมของท่าน โปรดแจ้งเราเป็นหนังสือ

    โปรดทราบว่าการถอนความยินยอมของท่านจะไม่กระทบต่อสิทธิในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลที่สามารถกระทำได้โดยไม่ต้องขอความยินยอมตามกฎหมายที่บังคับใช้ได้อนุญาตหรือกำหนดให้ต้องกระทำ รวมถึงการประมวลผลข้อมูลส่วนบุคคลในขณะที่ท่านได้ให้ความยินยอมโดยชอบด้วยกฎหมายเอาไว้

    สิทธิในการเข้าถึง
    ท่านมีสิทธิขอเข้าถึงข้อมูลส่วนบุคคลของท่านที่อยู่ภายใต้ความรับผิดชอบของเรา และขอให้เราทำสำเนาของข้อมูลดังกล่าวหรือข้อมูลเกี่ยวกับวิธีการใช้หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน

    สิทธิขอให้แก้ไขข้อมูล
    ท่านมีสิทธิขอแก้ไขข้อมูลส่วนบุคคลของท่านที่เรามีให้ถูกต้อง เป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิด โดยท่านสามารถส่งคำร้องของท่านเป็นหนังสือหรือผ่านทางช่องทางการติดต่อที่ระบุไว้ข้างใต้นี้

    สิทธิขอถ่ายโอนข้อมูล
    ท่านมีสิทธิขอรับข้อมูลส่วนบุคคลของท่านในกรณีที่เราได้จัดทำข้อมูลส่วนบุคคลนั้นอยู่ในรูปแบบที่สามารถอ่านหรือใช้งานได้ด้วยเครื่องมือหรืออุปกรณ์ที่ทำงานได้โดยอัตโนมัติและสามารถใช้หรือเปิดเผยข้อมูลส่วนบุคคลได้ด้วยวิธีการอัตโนมัติ รวมถึงมีสิทธิในการขอให้เราส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่นหากสามารถทำได้ด้วยวิธีการอัตโนมัติและมีสิทธิขอรับข้อมูลส่วนบุคคลที่เราส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่นโดยตรง เว้นแต่ไม่สามารถดำเนินการได้เพราะเหตุทางเทคนิค

    สิทธิขอคัดค้าน
    ท่านมีสิทธิขอคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านในเวลาใดก็ได้ หากการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านที่ทำขึ้นเพื่อการดำเนินงานที่จำเป็นภายใต้ผลประโยชน์โดยชอบด้วยกฎหมายของเราหรือของบุคคลหรือนิติบุคคลอื่น โดยไม่เกินขอบเขตที่ท่านสามารถคาดหมายได้อย่างสมเหตุสมผลหรือเพื่อดำเนินการตามภารกิจเพื่อสาธารณประโยชน์

    สิทธิขอให้ลบข้อมูล
    ท่านมีสิทธิขอให้เราลบหรือทำลายข้อมูลส่วนบุคคลของท่านหรือทำให้ข้อมูลส่วนบุคคลเป็นข้อมูลที่ไม่สามารถระบุตัวได้ หากท่านเชื่อว่าข้อมูลส่วนบุคคลของท่านถูกเก็บรวบรวม ใช้ หรือเปิดเผยโดยไม่ชอบด้วยกฎหมายที่บังคับใช้ หรือเห็นว่าเราหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์ที่เกี่ยวข้องในประกาศฉบับนี้ หรือเมื่อท่านได้ใช้สิทธิขอถอนความยินยอมหรือใช้สิทธิขอคัดค้านตามที่แจ้งไว้ข้างต้นแล้ว

    สิทธิขอให้ระงับการใช้ข้อมูล
    ท่านมีสิทธิขอให้ระงับการใช้ข้อมูลส่วนบุคคลชั่วคราวในกรณีที่เราอยู่ระหว่างตรวจสอบตามคำร้องขอใช้สิทธิขอแก้ไขข้อมูลส่วนบุคคลหรือขอคัดค้านของท่าน หรือกรณีอื่นใดที่เราหมดความจำเป็นและต้องลบหรือทำลายข้อมูลส่วนบุคคลของท่านตามกฎหมายที่เกี่ยวข้องแต่ท่านขอให้เราระงับการใช้แทน

    สิทธิร้องเรียน
    ท่านมีสิทธิร้องเรียนต่อผู้มีอำนาจตามกฎหมายที่เกี่ยวข้อง หากท่านเชื่อว่าการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านโดยเรา เป็นการกระทำในลักษณะที่ฝ่าฝืนหรือไม่ปฏิบัติตามกฎหมายที่เกี่ยวข้อง
  2. เราจะตอบกลับคำร้องขอของท่านโดยเร็วที่สุดที่จะทำได้ โดยทั่วไปแล้ว เราจะตอบกลับท่านภายในระยะเวลาไม่เกินสิบสี่ (14) วันทำการ ทั้งนี้ หากเราไม่สามารถตอบกลับคำร้องขอของท่านได้ภายในระยะเวลาสามสิบ (30) วันภายหลังจากที่ได้รับคำร้องของท่านนั้น เราจะทำการแจ้งท่านเป็นหนังสือภายในระยะเวลาสามสิบ (30) วันภายในระยะเวลาที่เราสามารถแจ้งท่านได้ หากเราไม่สามารถจัดเตรียมข้อมูลส่วนบุคคลของท่านหรือแก้ไขให้มีความถูกต้องตามที่ท่านได้ร้องขอ เราจะแจ้งท่านถึงเหตุผลที่เราไม่สามารถกระทำการนั้นได้

การรักษาความมั่งคงปลอดภัยของข้อมูลส่วนบุคคล

  1. เพื่อป้องกันข้อมูลส่วนบุคคลของท่านจากการถูกเข้าถึง เก็บรวบรวม ใช้ เปิดเผย คัดลอก เปลี่ยนแปลง หรือลบทิ้งโดยไม่ได้รับอนุญาต หรือความเสี่ยงที่คล้ายกัน เราได้จัดให้มีมาตรการบริหารการจัดการที่เหมาะสม และมาตรการทางกายภาพและเทคนิค เช่น โปรแกรมป้องกันไวรัสที่เป็นปัจจุบัน การเข้ารหัส การใช้ตัวกรองเรื่องความเป็นส่วนตัว และการเปิดเผยข้อมูลส่วนบุคคลภายในองค์กรและผู้ให้บริการภายนอกที่ได้รับอนุญาตและตัวแทนที่มีหน้าที่ที่จะต้องคงไว้ซึ่งความลับในข้อมูลส่วนบุคคลของท่านโดยการปฏิบัติตามมาตฐานการรักษาความปลอดภัยในข้อมูลและนโยบายต่าง ๆ เมื่อข้อมูลส่วนบุคคลได้มีการใช้ ส่ง โอน หรือได้มีการประมวลผลเกิดขึ้น
  2. ทั้งนี้ ท่านควรตระหนักไว้ว่าไม่มีวิธีการส่งผ่านข้อมูลบนอินเทอร์เน็ตหรือวิธีการจัดเก็บแบบอิเล็กทรอนิกส์ใดที่จะมีความปลอดภัยโดยสิ้นเชิง ในขณะที่ความปลอดภัยนั้นไม่สามารถรับรองได้ เราจะพยายามปกป้องความปลอดภัยในข้อมูลของท่านและจะทำการตรวจสอบและเพิ่มประสิทธิภาพในมาตรการรักษาความปลอดภัยทางข้อมูลของเราให้ดียิ่งขึ้น

ความถูกต้องของข้อมูลส่วนบุคคล

  1. โดยทั่วไปเราจะอาศัยการใช้ข้อมูลส่วนบุคคลที่ท่านให้เรา (หรือตัวแทนผู้มีอำนาจของท่าน) เพื่อให้มั่นใจได้ว่าข้อมูลส่วนบุคคลของท่านนั้นเป็นปัจจุบัน สมบูรณ์ และถูกต้อง โปรดแจ้งการเปลี่ยนแปลงกับเราหากมีความเปลี่ยนแปลงเกิดขึ้นกับข้อมูลส่วนบุคคลของท่านโดยการติดต่อเราผ่านช่องทางการติดต่อที่ได้ระบุไว้ข้างใต้

ระยะเวลาการจัดเก็บข้อมูลส่วนบุคคล

  1. เราจะเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้ตามระยะเวลาที่จำเป็นในการปฏิบัติตามวัตถุประสงค์ที่ข้อมูลดังกล่าวถูกเก็บรวบรวม หรือตามที่ได้กำหนดหรืออนุญาตโดยกฎหมายที่เกี่ยวข้อง
  2. เราจะทำการยกเลิกการจัดเก็บรักษาข้อมูลส่วนบุคคลของท่านหรือลบทิ้งในข้อมูลที่เกี่ยวข้องกับท่านนันทีหากมีเหตุผลที่ทำให้เชื่อได้ว่าการเก็บรักษาดังกล่าวไม่มีความจำเป็นต่อวัตถุประสงค์ที่ได้เก็บรวบรวมมาและไม่มีความจำเป็นทางกฎหมายหรือวัตถุประสงค์ทางธุรกิจอีกต่อไป

การโอนข้อมูลส่วนบุคคลไปต่างประเทศ

  1. โดยทั่วไปเราจะไม่โอนข้อมูลส่วนบุคคลของท่านไปนอกประเทศไทย อย่างไรก็ตาม หากเรามีการโอนข้อมูล เราจะทำการขอความยินยอมจากท่านเพื่อการโอนข้อมูลดังกล่าวและจะทำให้มั่นใจว่าประเทศปลายทางนั้นได้จัดให้มีมาตรการความปลอดภัยที่เหมาะสมและข้อมูลส่วนบุคคลของท่านจะยังคงได้รับมาตรฐานความคุ้มครองที่สามารถเทียบเคียงกับกฎหมายคุ้มครองข้อมูลส่วนบุคคล
  2. เนื่องจากเรามีเครือข่าย แหล่งจัดเก็บข้อมูล เซิร์ฟเวอร์ ระบบทำงาน การสนับสนุน ระบบการช่วยเหลือลูกค้า (Help desk) อยู่ในสำนักงานของเราทั่วโลก เราจึงร่วมมือกับบุคคลภายนอก เช่น บริการคลาวด์โฮสติ้ง ซัพพลายเออร์ และการสนับสนุนด้านเทคโนโลยีที่ตั้งอยู่ทั่วโลก เพื่อตอบสนองความต้องการของธุรกิจ พนักงาน และลูกค้าของเรา เราดำเนินการตามขั้นตอนที่เหมาะสมเพื่อให้มั่นใจว่าข้อมูลส่วนบุคคลได้รับการประมวลผลที่ปลอดภัย และถ่ายโอนโดยเป็นไปตามกฎหมายที่บังคับใช้ ในบางกรณี เราอาจมีความจำเป็นจะต้องเปิดเผยหรือโอนข้อมูลส่วนบุคคลของท่านภายในท็อปคอนหรือไปยังบุคคลภายนอกซึ่งอยู่ภายนอกประเทศไทย พื้นที่ที่ผู้รับข้อมูลเหล่านี้ตั้งอยู่จะแตกต่างกันไปเป็นครั้งคราว แต่อาจได้แก่ สหรัฐอเมริกา ญี่ปุ่น ยุโรป สิงคโปร์ และประเทศอื่นใดที่ท็อปคอนอาจตั้งอยู่หรือที่ท็อปคอนได้ให้บริการ

เทคโนโลยีติดตามตัวบุคคล (Cookies)

การแจ้งเหตุละเมิดข้อมูลส่วนบุคคล

  1. ในกรณีที่มีเหตุละเมิดข้อมูลส่วนบุคคลของท่านเกิดขึ้น เราจะแจ้งให้สำนักงานคณะกรรมการคุ้มครองข้อมูลส่วนบุคคลทราบโดยไม่ชักช้าภายใน 72 (เจ็ดสิบสอง) ชั่วโมง นับแต่ทราบเหตุเท่าที่สามารถกระทำได้ ในกรณีที่การละเมิดมีความเสี่ยงสูงที่จะมีผลกระทบต่อสิทธิและเสรีภาพของท่าน เราจะแจ้งการละเมิดดังกล่าวให้ท่านทราบพร้อมกับแนวทางการเยียวยาโดยไม่ชักช้าผ่านช่องทางต่าง ๆ เช่น  เว็บไซต์ ข้อความ (SMS) อีเมล โทรศัพท์ ไปรษณีย์ลงทะเบียน (หากทำได้)

การเชื่อมต่อไปยังเว็บไซต์อื่น

  1. ประกาศฉบับนี้ใช้สำหรับนำเสนอสินค้าหรือบริการ และการใช้งานบนเว็บไซต์ของเราเท่านั้น เว็บไซต์อื่นใดจากโดเมนอื่นที่ปรากฎบนเว็บไซต์ของเราจะเป็นไปตามประกาศว่าด้วยความเป็นส่วนตัวหรือนโยบายความเป็นส่วนตัวของเว็บไซต์นั้น ซึ่งเราไม่มีส่วนเกี่ยวข้องด้วย

การบังคับใช้และการแก้ไขเปลี่ยนแปลงประกาศว่าด้วยความเป็นส่วนตัว

  1. ประกาศฉบับนี้บังคับใช้ควบคู่กับประกาศฉบับอื่น ๆ ข้อสัญญาและการขอความยินยอมที่เกี่ยวข้องกับการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านโดยเรา
  2. เราอาจทำการแก้ไขประกาศนี้เป็นครั้งคราวโดยไม่ต้องแจ้งให้ท่านทราบล่วงหน้า ท่านสามารถตรวจสอบว่ามีการเปลี่ยนแปลงเกิดขึ้นหรือไม่โดยการอ้างอิงวันที่ที่มีการเปลี่ยนแปลงล่าสุดของประกาศฉบับนี้ การดำเนินการใช้บริการต่อไปของท่านย่อมถือได้ว่าท่านรับทราบและยอมรับในการเปลี่ยนแปลงดังกล่าว

ประกาศฉบับนี้แก้ไขล่าสุดและมีผลใช้บังคับตั้งแต่วันที่ 19 ตุลาคม พศ. 2564.
